If a person brings straw or stubble into the public domain in order to make fertilizer and someone is injured by it, he is liable and whoever comes first may claim the straw or stubble as his own. (This is a penalty imposed by the Sages for leaving them in the public domain.) Rabban Shimon ben Gamliel says that if someone creates a hazard in the public domain and another is injured by it, he must pay and whoever comes first can claim it. If a person turns (ownerless) manure in the public domain (intending to acquire it for fertilizer) and another is injured by it, he is responsible for damages.

Baba Kama 3:4

Let’s say that two potters were walking single file. If the first one fell and the second one tripped over him, the first one is liable for the second’s injuries.
