3,330. A Non-Kohein's Use of Oil for Burning

If the animals of a kohein are next to the animals of a Yisroel, or if garments of a kohein are being woven next to the garments of a Yisroel, then (terumah) oil for burning may be lit for them without obtaining the kohein’s consent. Similarly, one may light the oil for burning in shuls, study halls and dark alleys without obtaining the kohein’s consent. One who doesn’t have regular oil to light a Chanukah menorah may light oil for burning without obtaining a kohein’s consent. We may light oil for burning for a sick person with a kohein’s consent.

If a Yisroel’s daughter who is married to a kohein visits her father regularly, he may light oil for burning with her permission. A kohein may light oil for burning in a shiva house or at a wedding even though there are many people present because we are not concerned that someone may take some of it. People at a wedding won’t touch it out of fear of soiling their clothes, while people in a shiva house won’t be inclined to do so in front of the mourner.
