3,427. Splitting the Produce Between Partners

A “chokar” is a person who leases a field in exchange for a certain volume of produce regardless of the field’s ultimate yield. A sharecropper rents a field in exchange for a percentage of its crop, be it one-half, one-third, or whatever the parties agree to. A “sochar” is a person who rents real estate for money.

If two people jointly receive a field as sharecroppers, inherit it, or join as partners in it, one may tell the other take the wheat of location A while he will take the wheat of location B, or that he should take the wine from location X while the other takes the wine from location Y. He may not, however, say, “You take the wheat and I’ll take the barley” or “You take the wine and I’ll take the oil,” because that would be selling untithed produce.
