3,446. Separating Tithes on Shabbos

Hilchos Maaser 9:7

Let’s say that someone invites a friend for a Shabbos meal and the guest doesn’t consider the host to be reliable when it comes to tithes. In such a case, before Shabbos the guest says, “What I will separate tomorrow is tithes, and the rest of the tithes are next to it. What I designate as tithes is terumas maaser for the rest that is next to it. The second tithe is in the north – or the south – and its sanctity is transferred to money.” One may stipulate regarding demai even though it’s not yet in his possession, but if we know that tithes weren’t taken, then one may only stipulate regarding produce in his possession.

Hilchos Maaser 9:8

Pursuant to the previous halacha, let’s say that someone had 100 untithed figs in his house but he’s in the beis midrash or the field. He’s concerned that night may fall and he won’t be able to tithe them on Shabbos. In such a case, he says, “The two figs that I’ll put aside are terumah. The next ten that I take are first tithe. The last nine that I take are second tithe.” The next day, he acts accordingly, after which he may eat the figs.
