3,484. Buying Produce From a Homeowner

Hilchos Maaser 14:3

If someone buys produce from a homeowner (as opposed to a shopkeeper) and then he buys more of the same species from him, he may take tithes from one batch for the other. This is so even when he buys the produce from two different vessels, or even in two different cities. This is because we assume that a homeowner only sells his own produce.

Hilchos Maaser 14:4

If a homeowner sells vegetables in the market, if they come from his gardens, one may tithe from one batch for all of them. However, if he also brought produce from other gardens, then if one buys a bundle from him and then he buys a second bundle, then he may not tithe from one batch for the other.
