3,498. Second Tithe That Partially Entered Jerusalem

Hilchos Maaser Sheini and Neta Revai 2:7

Let’s say that someone eats second tithe produce that partially entered Jerusalem and partially didn’t. If he eats the part that didn’t enter Jerusalem, he receives stripes for acting rebelliously; if he eats the part that entered Jerusalem outside of that city, then he receives lashes.

Hilchos Maaser Sheini and Neta Revai 2:8

Second tithe is only redeemed in Jerusalem if it is rendered ritually unclean, as per Deuteronomy 14:24: “If the place (i.e., Jerusalem) is far from you...." We see that second tithe produce may be redeemed when Jerusalem is far, but not when it is close. If someone is in Jerusalem and his pack is outside – even if he’s carrying it on a pole – since the second tithe produce itself wasn’t brought into Jerusalem, it can still be redeemed next to the city wall.
