3,506. Giving Second Tithe to an Unlearned Person

The rule about not eating in a state of bereavement doesn’t only apply to second tithe; rather, it applies to all sacrificial foods. If one eats them in a Biblical-level state of bereavement, he is liable to the penalty of lashes; if he does so in a Rabbinic state of bereavement, he is liable to stripes for acting rebelliously.

Second tithe produce, food purchased with second tithe money, and the money from redeeming second tithe may not be given to an unlearned person because we assume that he is ritually unclean. One may eat second tithe that was separated from demai (doubtfully tithed produce) in a state of bereavement, and it may be given to an unlearned person so long as the owner eats an equal volume of other produce in their place. Second tithe may not be stored with another person, not even a learned person, out of concern that he may die and the produce will end up in the possession of his unlearned son. One may, however, store second tithe taken from demai with an unlearned person.
