3,531. Avoiding Paying the Extra Fifth

Similar to the case in the previous halacha, one is permitted to act cleverly and give second tithe produce as a gift before it’s tithed. When giving it, he declares that the sanctity of the produce is transferred to money that he has at home.

Brothers, partners or a father and son may redeem second tithe for each other in order to avoid the requirement to add a fifth. If a woman brings second tithe to her husband’s house, he doesn’t acquire it because it belongs to God, as has already been discussed. Therefore, if the husband redeems it, he is not required to add a fifth.
