3,564. Trees Planted in the Month of Av

Pursuant to the previous halacha, if someone plants a fruit tree on the fifteenth day of the month of Av in the tenth year of the fifty-year Yoveil (Jubilee) cycle, it is considered orlah until Tu b’Shevat in the thirteenth year. The fruit that grows until then is orlah, even if it ripened after that date. The produce from Tu b’Shevat of the thirteenth year until Tu b’Shevat of the fourteenth year is neta revai; whatever grows during that time must be redeemed. If one of those years is declared a leap year (so that an extra month of Adar is added), the fruit that grows in that extra month is orlah or neta revai, as appropriate.

If a tree was planted on the sixteenth day of the month of Av in the tenth year, that year is not counted as the first year of orlah. Rather, it is orlah for the eleventh through thirteenth years, and it is neta revai from Rosh Hashana of the fourteenth year until the end of that year.
