3,570. Trees Already in Israel When the Jews First Entered

Hilchos Maaser Sheini and Neta Revai 10:9

If a tree is planted inside a house, the rules of orlah apply. Trees planted by non-Jews before the Jews entered Israel (in the time of Joshua) were exempt from orlah. After the Jews entered Israel, orlah applied even to trees planted by non-Jews. This is derived from Leviticus 19:23: “When you enter the land and plant…,” which indicates that the rules of orlah would take effect when the Jews entered Israel.

Hilchos Maaser Sheini and Neta Revai 10:10

If a non-Jew grafts a fruit tree to a non-fruit tree, orlah applies. If a non-Jew voluntarily chooses to observe neta revai, his produce is sanctified like the neta revai of a Jew.
