If the neighbor (from the case in the previous halacha) gave him a spot to extend the tree onto his land, even for a little while, he brings first fruits. If the tree was near the neighbor’s property line or bent into the neighbor’s field, then even though he should have moved what he planted, he still brings first fruits and reads the recitation over them. This is because Yehoshua caused the Jews to inherit the land with this condition.

Even though Exodus 23:19 says “the first fruits of your land,” first fruits are not brought by sharecroppers, renters, those who coerce landowners to sell their property for less than it’s worth, and those who steal land. This is the case even if the rightful owners give up hope of ever getting their land back.
