3,611. Who Doesn't Recite the First Fruits "Confession"

The following people bring first fruits but do not recite the “confession”: a woman, a person of indeterminate gender, and an intersex person (formerly called a “hermaphrodite) because there’s a doubt as to whether they’re male or female. This is because only men can recite the part of the “confession” about “the land which You gave me,” referring to ancestral land. Similarly, one’s guardian, servant or messenger doesn’t recite the “confession” because they can’t say “which You gave me,” since the fruit is coming from land that isn’t his.

A convert brings first fruits with the “confession” because Genesis 17:5 tells us that Avraham will be “father to a multitude of nations.” He is the father of all who enter God’s metaphorical embrace (i.e., converts are considered his descendants). The promise that Avraham’s descendants would inherit the land was given to him before it was given to Israel (so converts are included). Likewise, kohanim and Leviim who bring first fruits recite the “confession” because they were given cities.
