3,614. Changing Who's Bringing the First Fruits

If someone puts aside first fruits and falls deathly ill, his heir brings the first fruits without reciting the “confession.” Let’s say that someone separates first fruits and sends them with a messenger, but the messenger dies en route to Jerusalem. Even if the owner ends up bringing them himself, he doesn’t recite the “confession.” This is derived from Deuteronomy 26:2: “You shall take... and you shall bring.” We see that the taking and the bringing must be done as a unit.

Let’s say that someone separated first fruits, but they were lost before reaching the Temple Mount so the person separated other fruits in their place. In such a case, he brings those second fruits but he doesn’t recite the “confession.” This is because he can’t recite the part about bringing “the first fruits of the land,” since these aren’t the first fruits. One need not add a fifth if he eats such second fruits as one would have to do for eating first fruits.
