3,993. Sticking Your Hand Into the Temple

The Rambam opines that one is only subject to the penalty of lashes for clothes that are a primary source of ritual impurity, such as if they were touched by someone who was unclean from corpse impurity. These are rendered a primary source of impurity, as will be discussed IY”H in Hilchos Tumas Meis. However, if a person brings into the Temple a garment of first-degree impurity, he is not subject to lashes, though he does receive stripes for acting rebelliously.

Similarly, if someone who is ritually unclean sticks just his hand into the Temple, he is given stripes for acting rebelliously. This is also true of one who intentionally enters the Temple before immersing to cleanse himself from things that are primary sources of impurity under Rabbinic law, or from eating or drinking ritually unclean food or beverages.
